Plain English
Nudge is a premium controller for the Sonos system you already own. Subscribe and you can use it on your iPhone and Apple Watch, and let people in your home control your speakers through DJ Access, for as long as your subscription is active. We don't sell your listening data. The full terms are below, and this summary is for convenience only. The Terms that follow control.
Nudge is made by Bolton LLC. It is not made by Sonos and is not an official Sonos product. "Sonos" is a trademark of Sonos, Inc.
Agreement to These Terms
These Terms of Use are an agreement between you and Bolton LLC ("the Company," "we," "us," or "our"), the maker of Nudge. By downloading, installing, or using Nudge, you agree to them. If you do not agree, do not use the app. Your use is also governed by our Privacy Policy, which explains how we handle information and is part of this agreement. Please read both before using Nudge.
Definitions
- Nudge or the app is the software we provide for your Apple devices, including the iPhone and Apple Watch apps, distributed through the Apple App Store.
- DJ Access is the feature that lets you give other people temporary control of your Sonos system without sharing your account credentials.
- Service means Nudge and the features, content, and updates we provide through it.
- Subscription is paid, recurring access to Nudge.
- Sonos means Sonos, Inc., the maker of the speakers and platform that Nudge controls. Sonos is not affiliated with the Company.
- You means the person using Nudge, or the entity you act for.
Who Can Use Nudge
You must be at least 13. If you're under the age of majority where you live, you may use Nudge only with a parent or guardian who agrees to these Terms for you and is responsible for your use, including any charges.
License to Use Nudge
We grant you a limited, non-exclusive, non-transferable, revocable license to use Nudge on Apple devices you own or control, for personal, non-commercial use, subject to Apple's App Store terms and standard licensed-application terms. You may not copy, modify, distribute, sell, sublicense, or reverse engineer the app, except to the extent applicable law permits.
Your Sonos System and the Sonos App
Nudge controls Sonos hardware and services you already own. The official Sonos app stays the authoritative tool for setup, account management, EQ, Trueplay, alarms, and structural changes, and you may still need it for those. We're not responsible for the Sonos platform, its availability, or changes Sonos makes that affect Nudge. Your use of Sonos products is governed by Sonos's terms.
DJ Access
DJ Access lets you give others temporary control of your Sonos system without sharing your credentials. You choose who to invite and can revoke access at any time. As the host, you're responsible for how your guests use it, and their use is subject to these Terms.
Acceptable Use
Use Nudge only for lawful purposes. Don't disrupt the app, attempt unauthorized access to it or any connected system, or use it in a way that infringes others' rights or breaks the law.
Subscriptions
Plans and billing. Nudge requires a paid Subscription, which may include a free trial for new subscribers. Current pricing, billing period, and any trial length are shown in the app and on the App Store before you purchase and may vary by region. Subscriptions are sold and billed through your Apple App Store account, and Apple's billing terms apply.
Free trial. If a free trial is offered, you are not charged until it ends. Unless you cancel at least 24 hours before the trial ends, your Subscription begins automatically and Apple charges the applicable fee. We may change or withdraw a trial offer at any time.
Auto-renewal and cancellation. When you subscribe, auto-renewal is on by default, and your Apple account is charged before each new period begins. Your Subscription keeps renewing at the end of every period until you turn off auto-renewal, which you can do anytime in your Apple account settings. To avoid the next charge, turn it off at least 24 hours before the current period ends. Cancelling stops future renewals; you keep access through the period you've already paid for, and unused time is not refunded.
Family Sharing. A Subscription can be shared with your family group through Apple Family Sharing, covering up to six people in your family group under Apple's rules. The Subscription holder is responsible for the Subscription and for family members who use it.
Refunds. Except where required by law, fees are non-refundable, and we do not credit partial or unused periods. App Store refund requests are handled by Apple under its policies.
Fee changes. We may change Subscription fees from time to time. We'll give you reasonable notice before a change takes effect, and any increase applies starting at your next renewal. If you don't agree, you can cancel before it takes effect.
Privacy and Your Data
Nudge is designed to be local-first. Information about what you play, your speaker names, and your listening history is intended to stay on your devices and your home network rather than on our servers. We use third-party analytics and crash-reporting providers to understand general, anonymized usage and to diagnose crashes so we can improve the app. We do not sell your personal information. Our Privacy Policy describes what we collect and how we handle it, and it controls if there is any conflict with this summary.
Third-Party Services
Nudge depends on third-party services, including Apple, the Sonos platform, and the music services you connect to Sonos. Each has its own terms and privacy policies. We don't control these services and aren't responsible for them, their availability, or changes they make that affect Nudge.
Intellectual Property
Nudge and its content, features, and design are the property of the Company and its licensors, protected by copyright, trademark, and other laws. Our name, logo, and trade dress may not be used without our written consent. Third-party marks, including Sonos and Apple, belong to their owners.
Your Feedback
If you send us feedback or suggestions, you grant us a worldwide, royalty-free license to use them freely and without obligation to you, including to improve the app.
Disclaimers
Nudge is provided "AS IS" and "AS AVAILABLE," without warranty of any kind. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement, and we don't warrant that the app will be uninterrupted or error-free. Nudge may be interrupted for maintenance, updates, or factors beyond our control, including changes to the Apple or Sonos platforms. Some jurisdictions don't allow these exclusions, so some may not apply to you.
Limitation of Liability
To the maximum extent permitted by law, we won't be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data, or goodwill. Our total liability for all claims won't exceed the greater of what you paid for Nudge in the prior twelve months or fifty U.S. dollars ($50). Nothing here limits liability that can't be limited by law.
Indemnification
You agree to defend and indemnify the Company and its officers, employees, agents, and licensors against any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of Nudge or your violation of these Terms.
Termination
We may suspend or terminate your access at any time, without notice, if you breach these Terms or use Nudge in a way that harms others or the Company. You can stop anytime by deleting the app and cancelling your Subscription through your Apple account. Provisions that should survive termination, including intellectual property, disclaimers, limitation of liability, and indemnification, will survive.
Disputes
If you have a dispute about Nudge, contact us first at support@bolton.llc. We'll try in good faith to resolve it, and most concerns are settled this way.
Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, excluding its conflict-of-law rules, along with applicable U.S. federal law. Bolton LLC is a Delaware limited liability company that operates from Massachusetts. Any dispute will be brought in the state or federal courts located in Massachusetts, and you consent to their jurisdiction. If you live outside the United States, any mandatory consumer protections of your home country still apply.
General
These Terms and the Privacy Policy are the entire agreement between you and the Company and replace any prior agreements. You may not assign them; we may assign them in a merger, acquisition, or sale of assets. If any provision is unenforceable, the rest stays in effect, and not enforcing a provision isn't a waiver of it.
Changes to These Terms
We may update these Terms from time to time. For material changes, we'll make reasonable efforts to give notice before they take effect. If you keep using Nudge afterward, you accept the update; if you don't agree, please stop using the app.
